지방교육분권 관련 조직･인사, 사무, 재정분야의법제와 쟁점 분석

The purpose of this research is to analyze the related laws and issues on educational decentralization and to present the direction of educational decentralization in the future. In this study, we examined the laws on educational decentralization, and specifically analyzed the legal system and issues in organization･personnel, office work, and finance fields. The analysis results are as follows. First, in the organization and personnel field, the problems indicated by analyzing ‘Decree on the Appointment of Public Education Officials’ are authority limitation acted by presidential decree and the Ministry of Education, appointment of the Deputy Education Superintendent, and ambiguous office work and authority independence in the principal appointment. Second, in the office work field, as a result of investigating ‘Local Autonomy Act’, ‘Local Education Autonomy Act’, and ‘Special Act on Decentralization and Restructuring of Local Administrative Systems’, ambiguous work allocation, numerous institutionally delegated affairs, and lack of continuity in promotion of decentralization became obvious problems. Third, in the finance field, through analysing ‘Local Finance Act’,Elementary and Secondary Education Act’, and ‘Local Education Subsidy Act’, unstable local educational fiscal subsidies, central government interference through special subsidies, and defrayment uncertainty of educational financial resources were the causes of conflicts.
