국내 초고속 인터넷 시장에서의 망중립성 규제

초록

Based on the analyses of market competition structure and current regulatory framework, this paper examines the feasible network neutrality regulation in the broadband market in Korea. The paper claims that the concept of Internet neutrality should not be unnecessarily rigid in order to conform to the market trend and the related technological advances. Such principle can be reasonably preserved through the equal access to the QoS network, the appropriate payment system for accessing to the QoS network, and the proper regulatory instruments against the possible control of specific information or services in the QoS network. To have equal access to the QoS network virtually, the substantial competition in the access market is a pre-requisite. For this, the paper suggests that the regulation of local loop unbundling (LLU) should be more effective and applied in a more technologically neutral way. The payment system for accessing to the QoS network can be based on the current autonomous payment system but it should be supported by the appropriate guidelines regarding peering or transit agreement that includes the consideration of QoS. Regarding the anti-competitive control of specific services or information, including intentional deterioration of competing services, can be regulated ex post under the current regulatory framework. For the effective regulation, however, the payment agreement should be guided to include detailed information regarding the level of QoS that is guaranteed.
