GATS의 전자적 서비스무역 분류에 관한 고찰

A Perspective on the GATS Taxonomy of Electronic Trade in Services

Since UR did not foresee the advent of the Internet, the WTO Agreement on Trade in Services (GATS) could not reflect on electronic trade in services. Fortunately, GATS negotiations put electronic trade in services in its domain. However, there has been little progress to date on how to accomodate the electronic delivery of services in the context of GATS modes of supply. It means that the pending issue is not a simple classification question but a complicated puzzle which is related with fundamental interests of the WTO members such as liberalization of electronic trade in services, stability of the Agreement, member's jurisdiction and burden of market-opening negotiations. This paper probes the effective ways to cope with the classification of electronic delivery of services in the GATS process. It show as a result that approaches to directly deal with the classification issues have little possibility of getting at consensus among members. Rather, identical listing of commitments on cross-border supply (mode 1) and consumption abroad (mode 2) is a good solution to work out the problem to the extent that services negotiations is successful.
