국가연구개발사업과 WTO 보조금협정의 조화방안 연구

초록
"National research and development project" shall refer to a research and development project in the field of science and technology involving research and development tasks that are specified by the central administrative agency based on laws and the research and development expenses for which are wholly or partially funded publicly or by investment. National R&D projects are usually supported by national budgets, which may be recognized as state subsidies and violate international trade norms. The main issue of subsidies for R&D will be addressed in particular within the framework of the WTO Agreement on Subsidies and Countervailing Measures. In other words, the key point is that the possibility of violation of the WTO subsidy agreement of the national research and development project. This article outlines the contents of the international norms on the subsidies agreement, and then draws up legal policy implications after examining the cases where the national R&D project became a problem in the international trade law. In this way, the WTO panel on R&D subsidies has indicated that the panel's most common concern is 'specificity' of subsidies. As for the specific performance, which is the most important issue in the panel verdict process, it can be confirmed that the financial support of the indirect support method is advantageous in the aspect of avoiding specificity. In addition, although public advertisement of government agencies regarding national R&D projects may be a drug for domestic publicity to publicize the korean government, it may be negative in the event of a dispute as a starting point for separating the panel verdicts.
