Analysis on the Important Court Decisions in 2017 : Debtor Rehabilitation and Bankruptcy Act
초록
This article reviews some important decisions of the Supreme Court in 2017 with regard to the Debtor Rehabilitation and Bankruptcy Act. - the petition for bankruptcy amounts to an abuse of bankruptcy procedures ; scope of estate claims ; exercising avoidance power(The lawsuits of avoidance power shall be placed under the exclusive jurisdiction of the court with pending bankruptcy cases) ; prohibition on offset ; scope of effect of rehabilitation plan ; alteration of rights according to the rehabilitation plan ; evaluate the value of the subject matter of his/her security right ; confirmation of individual rehabilitation claims, effect of judgment in a lawsuit on confirmation of individual rehabilitation claims.
