GATS 국내규제와 투명성 규범에 관한 연구

초록

Trade in Services is affected by a variety of domestic regulations. Meanwhile the General Agreement on Trade in Services (GATS) explicitly recognizes the right of Members to regulate, and to introduce new regulations on the supply of services within their territories in order to meet national policy objectives. A central question on the discussions of GATS domestic regulation is, therefore, how best to strengthen disciplines without unduly curtailing national regulatory freedom. Transparency is in the center of these discussions. This study analyzes transparency principles in GATT, SPS, TBT, GATS, and Disciplines on Domestic Regulation in the Accountancy Sector. The results of this study reveal that transparency disciplines in GATS domestic regulation may not put burdens on Korean legislation. This study also introduces discussions on the scope and range of GATS domestic regulation and supports the idea of the least intervention and maximum sovereignty.
