대안적 분쟁해결(ADR)을 통한 공공갈등의 관리: 해외사례 비교분석

초록

In the rapid shift to participatory governance in which various actors actively involve in policy processes, the dispute resolution system through the formal litigation process no longer functions as an effective conflict management mechanism. Active and participatory methods for conflict management based on trust among policy participants need to be developed. In this situation, alternative dispute resolution(ADR) is emerging as an effective way to manage not only private sector conflicts but public conflicts. This study attempted to expand the concept of ADR as a management method for public conflicts in Korea through a comparative analysis of ADR systems in major countries such as the U.S., the U.K., France, and Japan. Further, it offered important suggestions to foster ADR in Korea, focusing on the administrative ADR system.
