2021년 전부개정 지방자치법은 자치분권2.0시대의 개막을 의미하는가?

This study analyzes the contents of the amendments to the Local Autonomy Act for 32 years since the 1988 fully amended Local Autonomy Act revision to the 2021 fully amended Local Autonomy Act by each article, and examines the difference between 2021 Local Autonomy Act revision and the previous Local Autonomy Act revisions. By examining whether 2021 revision has any fundamental differences from the past revisions, this study aims to evaluate whether 2021 fully amended Local Autonomy Act corresponds to a paradigm shift from the 1.0 era of local autonomy to the 2.0 era of autonomy and decentralization, as the government claims. As a result of the analysis, it is clear that the 2021 fully amended Local Autonomy Act contains the largest institutional change since the 1988 fully amended Local Autonomy Act, and there are many differences from the previous series of Local Autonomy Act amendments in terms of the quantity of the amendment and the quality of the system change. However, there is no choice but to give a negative evaluation as to whether the 2.0 era of autonomy and decentralization has opened through the change of intergovernmental relations and the change from institutional autonomy and citizen’s autonomy. Despite this limit, expanding the diversity of local autonomy in the Act is meaningful in that it creates an important opportunity to make an essential change to the framework of uniform local autonomy.
