WTO 회원국의 기술규제 제·개정 통보(notification) 대응 전략 연구: 중국 화장품 산업을 대상으로

The phenomenon that WTO members use TBT to protect their own industries and to eliminate trade barriers that the STC raised against other countries' TBT is becoming more clear over time. According to the WTO agreement, the TBT issue resolution stage can be largely divided into the ‘Pre-dispute resolution stage’, the ‘Autonomous agreement stage’, and the ‘Judicial resolution stage’. Looking at the WTO data, some TBTs were terminated in the pre-dispute resolution stage(the inquiry stage), but most of the STCs were terminated in the autonomous agreement stage of the TBT committee. And the case of developing to the judicial dispute resolution stage that makes a final and compulsory decision was extremely limited. The reason is that the Appellate Body (AB) is currently not operating in reality, so there is no practical benefit. And some TBT issues has been quickly resolved by the timely response of the company. In this study presents a universal strategy that can be used in the Autonomous agreement of the TBT Committee, which is the final stage of dispute resolution in reality. And detailed strategies according to each country's political and economic status are suggested. And this strategy was applied to the Chinese cosmetics-related technical regulations. As a result, 'Korea-China MRA negotiation strategy', 'China's full membership of ICCR and ‘requesting to serve as committee chair', 'raising the STC in solidarity with cosmetics non-exporting countries', and 'introduction of fast-track system to TBT committee' were presented as means of settlement. However, the above strategies may not be valid for the Chinese government.
