A Study on the Civil Enforcement Systems In South and North Korea

초록

South and North Korea's judgment enforcement system have a lot of fundamental differences. North Korea's legal system originate from the old socialist civil procedure, Soviet Union and People's Republic of China. South Korea's legal system originates from mainly German and partly U.S.A. Due to these fundamental differences and insufficient research materials, to study and research North Korea's judgment enforcement system has many obstacles. Particular situations of North Korea social system strengthens these difficulties. In spite of these difficulties, it is necessary to research North Korea's judgement enforcement system so as to help to solve the possible future problems of Gaesong Industrial Complex. North Korea has a judgement enforcement executive person under the court as a basic enforcement branch. But direct judgment enforcement by the bank is also allowed in the case of state branch, state company and the property of group. North Korea has a written enforcement note to the parties enforced by the enforcing body, which is similar to the system of People's Republic of China that revised 2012 due the misuses.
