초록

The term artificial intelligence was first used by John McCarthy at the 1956, Dartmouth Conference in the United States. The artificial intelligence itself is rarely used to manufacture devices. Artificial intelligence plays a similar role to software that increases efficiency in addition to the inherent functions of a particular device. Therefore, artificial intelligence can be directly reflected in characteristics of software such as network structure, externality, economies of scale, conversion cost and free ride. Is a artificial intelligence(AI) the product in the meaning of the product liability law? To answer the question, we used a legal principle to software. Especially whether AI is the product and who has statutory responsibility are very important issues in the ICT industry. In a political perspective, if we apply the product liability law to AI, the progress of AI industry which the government try to develop may be arrested. Nevertheless this paper covered that if AI is the product in according to the current law.
