Online Platform Operator’s Civil Liability – Focusing on ‘Open Market’(Online Marketplace) –

초록

The volume of online platform-based commerce has grown rapidly in recent years, owing to developments in Information and Communications Technology such as advent of access to ubiquitous mobile internet. An “open market”, in other words, an “online marketplace”, is a type of a market platform characterized by participations from multiple buyers and sellers, dealing with various classes of goods and services. In modern economy, the very existence and functions of online platform service providers are key elements in creating value. which can multiply and expand rapidly through the effects of (cross) network externality. Scholars and practitioners alike face the needs to clearly define the role of open markets and online platform businesses in the larger context of economy, as well as imposing proper liability to said market participants, to promote consumer rights and interests in an open market, and resolving disputes between consumers and sellers. Hence, an inevitable revision of the ‘Act on the Consumer Protection in Electronic Commerce’ (the Act) is proposed. The market consistently introduces novel and inventive business models of online platforms, steadily challenging the boundaries of consumer rights and interests. Mere modifications to the Act may prove inadequate in addressing the variety of emerging issues, and therefore other related laws and regulations may prove useful in supplanting the Act, after relevant modifications.
