국군의 강령과 군인정신의 재구성 : 군인복무기본법을 중심으로

With the establishment of the Basic Law on Military Service in 2016, not only the basic rights of military personnel but also the legal status was strengthened. The problem is that the military spirit-related parts are not systematically combined. This study is designed to strengthen the systematicness and logic of mental education through the reconstruction of the Code of the Armed Force and the military spirit presented in the Basic Law on Military Service and its Enforcement Ordinance. First of all, the ideology and mission of the Korean armed forces are separated in the "Construction of the Korean Armed Forces," which can be integrated into "the nature of the Korean armed forces," "fundamental tasks," and "future-oriented tasks." The terms of the military spirit separatedly deployed in the statutes should be reconstructed into two categories: (1) "honor," "courage" and "honesty" at the individual level and (2) "military discipline," "morale," unity" and "education & training" at the organization level, depending on the characteristics of the provisions. On the military spirit at the individual level, it is in conformity with the law to recognize the 'completion of duty' as an independent statute along with the existing six values. The individual-level military spirit will be able to gain internal relevance by reconstructing into 3 tiers: (1) "duty completion" as a goal, (3) behavioral norms (honor, courage, loyalty, belief in unfailing victory, & no retreat) for it, and (3) noble patriotism as a essential basis for them. In the case of an organization-level military spirit, these values should be secured not at the individual level but at the organization level. it should be also emphasized that military discipline and morale of armed forces can be strengthened through “education and training”. This conceptual integration and logical reconstruction will ensure an internal consistency between military, enabling a more systematic mental education.
