현행 형법의 텍스트언어학적 연구 - 텍스트 구조, 유형, 문법을 중심으로 -

초록

This paper aims to study the macro-structure and micro-structure, text type, and the characteristic use of vocabulary and grammar in the Korean criminal law text. The criminal law text consists of Part 1(the general provisions) and Part 2(gakchik). Part 1 consists criminal law, establishment of a crime, pains and penalties, and period punishment according to the specification of structure. Part 2 has 42 listed types of crime in parallel structure. It is crucial for legal text to have coherence between the top title and the lower title, the title and content. Therefore, it is necessary that law text use correct and appropriate vocabulary. However, criminal law text has some examples that damage coherence because of conservative vocabulary. The primary function of legal Text is providing information. Criminal legal text seems to have two additional functions which are obligation and appeal. In Chapter 4, the paper intensively explains the use of vocabulary and grammar that is distinguishing from normal usage. If these distinct usage is necessary for practicing law and legal text, it is essential to establish accurate and precise rules to prevent misunderstandings and confusion. Further legal text study is expected to analysis common and individual features in legal text.
