미국의 최신 독점규제 정책동향 및 경쟁법적 쟁점에 관한 연구

초록
Donald John Trump took office as the 47th President of the United States on January 20, 2025, but unlike the early days of former President Joseph Robinette Biden Jr., antitrust policies have not been highlighted as much. This is not because the Trump administration was particularly indifferent to antitrust policy, but rather because the Biden administration raised the issue of unusually strong enforcement of antitrust laws, and in particular, it was theoretically supported by the ideology of the “New Brandeis Movement.” The second Trump administration does not have a clear policy direction and does not highlight the ideology that supports it, but it is not particularly special considering that traditionally Republican governments have been relatively less active in antitrust regulation. In addition, since it is not easy for existing policies to fundamentally change just because the president changes in the United States, where the rule of law tradition is established, it is thought desirable to understand future antitrust regulation policies as an extension of the past. However, regardless of the country, when the government changes, significant changes in antitrust regulation policy are inevitable. In particular, since the antitrust regulation policy of the United States, the world's most powerful country, can have a significant impact on the world, countries with high external dependence like Korea cannot help but be greatly affected by such policy changes. Therefore, it is very important at this point to forecast future changes in the United States' antitrust regulation policy, closely examine competition law issues, and appropriately respond to them from Korea's perspective. The study examines the political inclination of the Republican Party to which the president belongs, the careers and philosophy of those appointed as the head of the antitrust regulatory agency, election pledges during the presidential campaign, or remarks at hearings by key figures. Since it is still early in the Trump presidency, studies or papers on the antitrust regulation policies of the second Trump administration are rare, so this study mainly analyzes government press releases, statements by key figures, congressional hearing materials, and media articles.
