하나의 사건에서의 이중(二重)재판에 관한 법리
초록
This article provides a legal analysis of an unusual case in which two final decisions were issued on different dates within a single non-contentious proceeding (an application for the recognition of litigation costs, including the remuneration of a special representative). A decision drafted as an electronic document is deemed to have been issued the moment the judge completes the judicial electronic signature. Once the judge’s signature is completed, the decision is registered in the computerized information processing system and notified (service) to the parties, at which point the decision is finalized and acquires legal effect. The court itself is bound by this decision and cannot arbitrarily revoke or alter it. On this basis, the article first examined the formation and effectiveness of the prior final decision, as well as the legal limits on canceling its electronic transmission of that prior final decision on the grounds of erroneous service. It further argued that, because an error in service cannot retroactively invalidate a decision once rendered, a subsequent decision in the same case constitutes an impermissible second decision and is therefore void. The article further highlights the difficulty of resolving such multiple judgments within the existing litigation framework, particularly in light of the system of dismissal without a hearing and the supplementary nature of retrials. Finally, to address these limitations directly, the article examines the necessity and legality of bringing an action for a declaratory judgment to invalidate the later decision.
